The Caribbean Court of Justice (CCJ) on Wednesday dismissed the appeal brought by Opposition Leader Azruddin Mohamed and his father, businessman Nazar Mohamed.

The appeal challenged the legality of the Authority to Proceed (ATP) issued by Minister of Home Affairs Oneidge Walrond in the extradition proceedings initiated against them at the request of the United States.

In its lead judgment, the CCJ upheld the decisions of both the High Court and the Court of Appeal, ruling that the Minister’s issuance of the Authority to Proceed (ATP) was an administrative function performed in accordance with the relevant extradition legislation.

It further held that the circumstances did not give rise to bias on the part of the Minister in issuing the Authority to Proceed.

The CCJ lifted the interim stay it had previously imposed and made no order as to costs, clearing the way for the extradition proceedings against the Mohameds to continue before Chief Magistrate Judy Latchman.

The United States is seeking the extradition of the Mohameds to face an 11-count criminal indictment, including allegations of conspiracy, mail and wire fraud, and money laundering.
